The complainant who is now 30 years old claims that the business man first raped her in Navua in 2014.
“In your search for justice you must know your facts.”
These were the words of Suva High Court Judge Justice Salesi Temo. This comes as the 30 year old complainant could not recall the dates or month in which she reported the matter to the police.
Justice Temo told the complainant that she was an adult and not a child. If she was really concerned about the alleged incident, she would have reported the matter sooner.
Justice Temo told the 30 year old that something must have went wrong for her to wait 2 years before reporting the incident to the police. She told the court that she could not go to the police because she was scared.
Justice Temo then told the complainant that according to the evidence her ways does tell the court that she did not consent as she could have ran away given the opportunity or called for help.
He also stressed that not only the accused is on trail but also the complainant as she is pointing a finger at him.
Navua businessman Govind Sami is facing charges of rape and indecently annoying a person.
The re-examination will continue today
